Introductory provisions
These conditions apply to the stay in the Saint Anthony Cottage accommodation facility, Stará Ves 103, 513 01 Vysoké nad Jizerou (hereinafter referred to as the “accommodation provider”).
The parties to the agreement are the accommodation provider and the client booking their stay. The client may be a natural or legal person (hereinafter referred to as the “client”). The client whose name and signature are on the contract represents all the participants in the stay, is authorised to act on their behalf, and is the only person responsible for the accommodation provider.
The customer agrees to these terms and conditions by confirming the booking with the accommodation. This agreement serves as accommodation regulations, too.

1. The origin of the agreement
The relation between the client and the accommodation provider is established by the confirmed booking of the reservation of the Saint Anthony Cottage, Stará Ves 103, 513 01 Vysoké nad Jizerou. The confirmation is carried out by the client in the online booking system or in another way upon the payment of the deposit/total amount for accommodation as specified in Article 3, subsection 3.4 of these Terms and Conditions. The customer shall pay the deposit/total amount for accommodation to the account of the accommodation provider. Both the client and the accommodation provider agree to the use of electronic communication (email).

2. The price for accommodation and payment terms
The price for the stay means the price indicated in the booking system and the info email that will be sent to the client after the booking has been confirmed in the online booking system.

3.1. The price for the stay includes  • Accommodation for 11 people • Wi-Fi • sauna • flowers • bed linen, towels, hairdryer • personal hygiene kits • firewood for the stove • outdoor seating with barbecue • garden shed/storage for storage skis and bicycles • final cleaning of the cottage • garbage removal • coffee • outdoor hot tub (it is necessary to order the heating of the barrel for a specific hour with the owner at least one day before).

3.2. The price for the stay does not include  • the local tourist fee to the municipality CZK 18/person/day • energy consumption (electricity CZK 6/kWh, gas for outdoor grill, water). The accommodation is meant for 11 people at maximum. For every additional person, including small children, there is a one-time fee of CZK 1,000 (the maximum number of guests is 12 persons).

3.3. The depositWhen receiving the key to the accommodation facility, the client must pay a refundable deposit of CZK 10,000 to the accommodation provider or a person authorised by the accommodation provider, either by depositing cash or by bank transfer before arrival. The deposit only guarantees to pay for the electricity and water used and cover any damages. The deposit will be returned to the client on the day of departure by the accommodation provider if the client has not caused any damage to the property. In the event of damage, the accommodation provider is entitled to reduce the deposit by an amount equal to the damage caused. If the deposit is insufficient, the compensation of damages shall be governed by clause 4.2 of these Terms and Conditions.

3.4. The payment for the stay The client is obliged to pay the reservation fee from the price of the stay within two days from the date of confirmation of the booking in the online reservation system. The remaining balance is due 30 days before the date of arrival unless otherwise agreed by the parties. Suppose the client fails to comply with the payment terms for the stay. In that case, the contract between the client and the accommodation provider will be terminated, and the accommodation capacity will be offered to other interested parties.

4. Client’s obligations. The client has agreed to:
• provide the accommodation provider with the necessary assistance to ensure the proper provision of accommodation.
• arrive on the due date.
• identify themselves with a valid identification. Suppose the customer refuses to provide proof of identity. In that case, the accommodation provider may not provide the accommodation or refund the amount already paid for the stay.
• follow the instructions and guidelines the accommodation provider and its authorised staff set.
It is the responsibility of the customer and every interested party to behave in such a way as to avoid causing harm to their health, life or property, as well as damage to the property of the accommodation provider.
• supervise the children or provide them with necessary supervision to prevent their possible injury in and around the property or damage to the property of the accommodation provider.
• use the accommodation properly and keep the premises clean and tidy.
• close the windows and doors when leaving the accommodation.
• report the need for repairs to the accommodation without further delay.
• report any damage or loss caused by the client or the person staying with them in the accommodation without further delay.

4.1 Without the prior consent of the accommodation provider, the client may not:
• make substantial changes to the accommodation premises (change the position of furniture, etc.)
• use their own electric appliances on the premises
• transfer the accommodation to another person

4.2. Damages caused by the client. Everyone has the right to cause damage by their carelessness or negligence. However, they are also obliged to pay for the damage caused. The client shall inspect the facilities in their own interest and report any deficiencies to the accommodation provider within the first day. Suppose any damages to the exterior and interior equipment subsequently occur. In that case, the client must pay them in full without further delay. Particular attention must be paid to the wastewater treatment plant (WWTP). There is a strict ban on pouring fats and oils down the drain. Pour edible oils into the composter, and throw in the napkin you used to wipe the pan. It is also forbidden to throw solid waste into the WWTP. Non-degradable materials such as diapers, sanitary napkins, condoms, ear-plucking cotton swabs, water wipes, plastic wraps, etc., are prohibited from being thrown into the toilet and waste. All these items are easily visible when the lid of the WWTP is opened. In case of non-compliance, a fine of CZK 2,000 is applied. If a defect is caused due to non-compliance with the above, payment of the cost of service/repair by a professional company is at the client’s expense.
Any heavy soiling of bedding (vomit, faeces, blood, etc.) is charged at CZK 2,500 per set of bed linen. Significant soiling of the interior or exterior of the accommodation facility is charged at the amount invoiced by the cleaning service company. The loss of a key is charged at CZK 2,500/piece. The client is obliged to pay for any damage incurred on the premises of the Saint Anthony Cottage accommodation facility, including compensation for lost profits in the amount of the applicable accommodation price for the entire period during which the property/room/relaxation area is out of service due to the damage caused. The client is also obliged to do so if the damage is caused by children or other persons staying with the client.
Be very cautious when heating with a wood-burning stove in the living room, and make sure to close the door properly. Starting fires for roasting sausages, marshmallows, etc… is prohibited in stoves. Wood is available from the accommodation provider. The stove serves as the boiler for the whole house, the heat is directed chiefly to the storage tank and the heat in the entire house is provided by underfloor heating in all rooms. Please do not overheat the stove; it will not add significant heat. If you are cold, reach out to the owner, who will set the underfloor heating at a higher temperature for the selected parts of the house.

5. Obligations, rights and responsibilities of the accommodation provider. The accommodation provider is obliged to hand over the accommodation premises to the customer in a condition suitable for proper use and to ensure the undisturbed exercise of the client’s rights related to the accommodation. The accommodation provider shall ensure that reported defects are rectified without further delay and maintain the premises in a proper technical and sanitary condition. The client agrees that for the entire duration of the stay, the accommodation provider or a person authorised by the accommodation provider (a maintenance worker, a security agency staff member, a cleaner, etc.) has the right to enter the accommodation to perform their professional duties. The accommodation provider has the right to inspect the accommodation in the client’s presence after the client’s stay. The clients are kindly requested not to consider this activity a sign of distrust. Thank you for your understanding. The accommodation provider is not liable for personal injury (or property damage) caused by the client’s carelessness, inattention, negligence, misuse or poor supervision.

6. Changes to the contract and withdrawal from the contract

6.1. Changes to the contract. Suppose the accommodation provider is forced to change the contract’s essential terms for objective reasons before the start of the stay. In that case, the client can agree to the change or withdraw from the agreement. If the client does not withdraw by written notice within 10 days from the delivery date of the proposal for change, the client shall be deemed to have agreed to the change.

6.2. Termination of the stay by the accommodation provider. The accommodation provider has the right to withdraw from this contract if the client grossly breaches the obligations set out in this contract. In such a case, the accommodation provider reserves the right to terminate the client’s stay before the expiry of the agreed period without being obliged to reimburse the client for the amount already paid for the stay. Reasons for termination of the stay include the stay of unregistered persons, violation of the ban on smoking in the cottage and adjacent premises, presence of animals and considerable damage to the inventory. Such cancellation by the accommodation provider does not affect the client’s obligation to pay all claims under this contract. Cancellation must be made in writing and delivered to the other party by email.

6.3. Cancellation by the Customer – Cancellation Policy. – The client has the right to withdraw from the accommodation contract. The client requesting cancellation at least 60 days before arrival will receive a 100% refund of the amount paid. If the client cancels their reservation between 60 – 30 days before arrival, they will receive 50% back. No refund is provided for all other events. In the event of early termination or interruption of the stay without fault on the part of the accommodation provider, the latter shall not be obliged to refund the client the price paid for the stay or its pro rata part.

7. Consent to the terms and conditions.  General terms and conditions apply to all stays in the Saint Anthony Cottage accommodation facility and come into force and effect on 24.12. 2022. By confirming the reservation in the booking system of the facility, the client agrees to these terms and conditions and confirms that they understand the above terms and conditions and accept them in full on behalf of themselves and the other persons staying with the client. This contract between the client and the accommodation provider is governed by Czech law. The Czech version of the contract is binding.

8.  CCTV system. For security reasons and the protection of our clients, a CCTV system is installed on the cottage’s exterior. The recordings are handled by the relevant legislation for the protection of personality.

9. Fire extinguisherA fire extinguisher is available in the room under the stairs. If a fire starts, the client must immediately call 150 and report the address Stará Ves 103, Vysoké nad Jizerou, 513 01.
